These Terms and Conditions ("Terms") govern your access to and use of the National Building Intelligence Platform ("NBIP", "the Platform", "we", "us", "our"), operated as a trading name of a sole trader based in the United Kingdom. NBIP is not a registered limited company.
By registering for or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms are governed by the laws of England and Wales.
3.1 You must be at least 18 years old and acting in a professional or business capacity to use the Platform.
3.2 The Platform is invite-only. Access is granted at NBIP's sole discretion. There is no self-serve registration. Submitting an access request does not guarantee activation.
3.3 You must provide accurate, complete, and current information when submitting an access request. You are responsible for keeping your account details up to date.
3.4 Authentication is via email magic link only. You are responsible for maintaining the security of your email account and any active session. You must not share access with any other person. Each account is for named-user access only.
3.5 We reserve the right to suspend or terminate accounts where registration information is found to be inaccurate, false, or misleading.
4.1 Commercial access to Building Intelligence Data and Strata Reports is subject to a paid engagement agreed in writing between you and NBIP. Pricing is determined on a case-by-case basis depending on scope, portfolio size, and use case.
4.2 Invoices are payable within 14 days of issue unless otherwise agreed in writing.
4.3 Access fees are non-refundable once access has been activated, except where required by law.
4.4 We reserve the right to revise commercial terms at any time. We will provide at least 30 days' written notice of any change affecting an active engagement.
4.5 NBIP is not currently VAT registered. No VAT will be charged on invoices issued during this period. If NBIP becomes VAT registered in the future, you will be notified in writing and subsequent invoices will reflect the applicable VAT position.
4.6 NBIP may suspend access immediately if payment is not received within 28 days of the invoice due date.
5.1 You may use Building Intelligence Data, Strata Reports, and Snapshots solely for lawful professional purposes within the scope of your agreed engagement with NBIP.
5.2 Permitted purposes include: asset due diligence, portfolio risk assessment, decarbonisation planning, regulatory compliance assessment, insurance underwriting research, climate risk analysis, energy strategy, and related professional advisory services.

5.4 We reserve the right to investigate any suspected breach and take appropriate action, including immediate suspension or termination of access without refund.
6.1 All Exports are marked with subscriber-identifying metadata including name, organisation, and export timestamp. This information is embedded in every file generated from the Platform.
6.2 NBIP maintains an audit log of all Export events. This log is available to NBIP administrators for monitoring and enforcement purposes.
6.3 You are responsible for the security and appropriate use of any Exports downloaded from the Platform. Downloaded files must be stored securely and not transmitted to unauthorised parties.
7.1 Building Intelligence Data is derived from authoritative UK government and public datasets and is updated periodically in line with available dataset releases. NBIP does not warrant that outputs are complete, accurate, or free from error at any given time.
7.2 Building Intelligence Data and Strata Reports are provided for professional informational purposes only. They do not constitute professional energy, legal, financial, structural, or construction advice. You should seek independent professional advice before making material decisions based on Platform outputs.
7.3 Confidence tiers and risk signals included in Strata Reports are indicative assessments based on fused public data. They do not constitute a formal survey, inspection, or professional certification of any kind.
7.4 Third-party data incorporated into the Platform is subject to the licensing terms of those respective sources. NBIP does not warrant the accuracy or completeness of third-party data.
7.5 Platform outputs are derived from publicly available property and energy datasets and are primarily directed at non-domestic buildings. Where outputs include addresses that could be associated with identifiable individuals, NBIP processes this data in accordance with the Privacy Policy and under the lawful basis of legitimate interests. The Platform is not designed or intended for use in identifying, profiling, or targeting individuals.
8.1 Platform IP. All intellectual property rights in the Platform — including its software, design, inference engine, fusion methodology, data models, scoring algorithms, and aggregated outputs — are owned by or licensed to NBIP. Nothing in these Terms transfers any such rights to you.
8.2 Licence. Your engagement grants you a limited, non-exclusive, non-transferable licence to use Building Intelligence Data and Strata Reports for the purposes set out in clause 5.1 only, for the duration of your active engagement.
8.3 Feedback. Any feedback or suggestions you provide to NBIP may be used by NBIP freely and without obligation.
8.4 Aggregated data. NBIP may use anonymised, aggregated, and non-personally identifiable data derived from Platform usage for research, benchmarking, and product development. This will never identify individual users or expose subscriber-specific data to third parties.
9.1 We process personal data in accordance with our Privacy Policy, available at nbip.uk/privacy. The Privacy Policy forms part of these Terms.
9.2 By using the Platform, you confirm that you have read and understood our Privacy Policy.
9.3 As a Subscriber, you act as an independent data controller in respect of any personal data you process using outputs from the Platform. You are responsible for ensuring compliance with UK GDPR, the Data Protection Act 2018, and all applicable privacy law.
9.4 We implement appropriate technical and organisational measures to protect data stored on the Platform against unauthorised access, loss, or destruction.
10.1 You agree to treat all Building Intelligence Data, Strata Reports, Exports, and non-public information relating to the Platform as Confidential Information.
10.2 You must not disclose Confidential Information to any third party without NBIP's prior written consent, except as required by law or regulation.
10.3 These confidentiality obligations survive termination of your engagement.
11.1 To the fullest extent permitted by law:
11.2 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless NBIP and its officers, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from:
13.1 You may close your account at any time by contacting us at contact@nbip.uk. Closure does not entitle you to a refund of any prepaid fees.
13.2 NBIP may suspend or terminate your access immediately and without notice if: (a) you breach these Terms; (b) payment is overdue by more than 28 days; (c) we reasonably suspect fraudulent or unlawful activity; or (d) we are required to do so by law.
13.3 On suspension or termination, your right to access the Platform and use Building Intelligence Data ceases immediately. All Exports in your possession must be deleted within 14 days of termination unless retention is required by law.
13.4 NBIP may revoke any active session associated with your account at any time, including upon suspension, termination, or at administrator discretion.
14.1 We may modify or discontinue the Platform, or any part of it, at any time. Where reasonably practicable, we will provide advance notice of material changes.
14.2 We may update these Terms from time to time. We will notify you of material changes by email or by a notice on the Platform. Continued use of the Platform after the effective date of any change constitutes your acceptance of the updated Terms.
14.3 The current version of these Terms is always available at nbip.uk/terms.
15.1 Building Intelligence Data is updated periodically following the release of relevant national government and public datasets. NBIP does not guarantee that any specific dataset update will be available by a particular date, as this is dependent on third-party publication schedules.
15.2 Your engagement includes access to the most recently published dataset available at the time of activation and any updates released during your active engagement period.
16.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
16.2 Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16.3 We will always try to resolve any dispute informally in the first instance. Please contact us at contact@nbip.uk before initiating formal proceedings.
17.1 Entire agreement. These Terms, together with the Privacy Policy and any written engagement agreement, constitute the entire agreement between you and NBIP in relation to your use of the Platform.
17.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver. Failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
17.4 Assignment. You may not assign your rights under these Terms without NBIP's prior written consent. NBIP may assign its rights under these Terms without restriction.
